What can happen if I do not report all substances or the report is incorrect?

In Germany, a legal ordinance is to be issued to regulate precise requirements and obligations. It can be assumed that this ordinance will also provide legal certainty for the companies concerned as to what happens if not all substances are reported or substances are reported incorrectly.

Another problem can arise when customers from other EU countries rely on the data provided. This is because each EU Member State has realised its own transposition of the Waste Framework Directive into national law. This may include fines for companies in case of incomplete or incorrect reporting.

Apart from the legal regulation, many companies on the customer side also demand the complete reporting of all substances in the database and rely on the suppliers for this. The handling of possible errors must therefore be regulated in contracts.
